Welcome to the MGA Rewards program (the "Program"), operated by MGA Entertainment, Inc. ("MGA", "we", "us", or "our"). The following terms and conditions (the "Terms") govern your participation in the Program. As used in these Terms, "you," "your," and "yours" refer to the individual who enrolls in, accesses, or participates in the Program. By participating in the Program, you agree to be bound by these Terms, as well as MGA’s Terms of Use and Privacy Policy. These Terms are meant to supplement and, unless stated otherwise, do not modify or supersede any provision in MGA’s  Terms of Use and Privacy Policy. If you do not agree to these Terms, please do not participate in the Program.

Eligibility

The Program is open to individuals who are legal residents of the United States and at least 18 years of age or older. Employees of MGA and its affiliates, subsidiaries, and their respective family members are not eligible to participate in the Program. Participation in the Program is limited to one (1) account per individual. Each account must represent a unique, identifiable person. Accounts created using shared, temporary, disposable, or alias email addresses for the purpose of obtaining duplicative sign-up rewards or promotional benefits are not eligible for the Program.

Enrollment

To enroll in the Program, visit our website at shop.mgae.com and click “Join Now”. You will need to provide your full name, email address, phone number, and create a password to register for the Program. Please make sure that the information you provide is accurate and up to date. You may only enroll in the Program once. Creating multiple accounts using variations of your name, email address, or other identifying information to obtain additional sign-up rewards or promotional benefits is prohibited and constitutes a violation of these Terms and MGA's Terms of Use. MGA reserves the right to link accounts that it reasonably believes are maintained by the same individual or household based on shared payment methods, shipping addresses, device identifiers, IP addresses, or other account attributes. By creating an account on our site, you consent to join MGA Rewards and receive marketing emails about the program as well as other offers and discounts available to members and/or customers. You may unsubscribe from emails at any time by clicking the unsubscribe button at the bottom of any email.

Earning Rewards

You can earn rewards in the Program by making purchases on our website or by participating in other activities that we may offer from time to time, such as taking surveys or referring friends. You will earn two points for every dollar you spend on eligible purchases, excluding taxes and shipping charges, and/or as stated in connection with your participation in other activities. Purchases made using rewards points are not eligible for earning rewards. Sign-up rewards and other one-time incentives may be earned only once per individual, regardless of the number of accounts created. MGA reserves the right to revoke rewards earned through conduct that violates these Terms.

Redeeming Rewards

You may redeem your rewards in the form of discounts on future purchases on our website, once your rewards credit balance reaches $5, or multiples of $5. Rewards are promotional and may not be redeemed for cash, gift cards, or any other products or services. Rewards are non-transferable and may only be used by the account holder. Unless expressly stated otherwise by MGA, rewards may not be combined with other promotional offers, discount codes, or sitewide promotions on the same order. MGA reserves the right, in its sole discretion, to restrict or exclude rewards redemptions from specific promotions or product categories at any time.

Rewards Expiration

Rewards expire one year from the date they were earned. If a reward has not been redeemed within one year, it will expire and will no longer be available for use.

Modification and Termination

MGA reserves the right to modify, add or delete portions of these Terms at any time, with or without notice, in its sole discretion. You are responsible for periodically checking for changes and/or updates to the Terms. Your continued participation in the Program after any changes to these Terms constitutes your acceptance of the updated Terms.

If MGA terminates the Program, any unused points and/or Rewards will expire and be void when the Program is terminated. Upon termination of your account, all points and/or Rewards that you have accumulated will immediately expire.

MGA reserves the right, in its sole discretion and without prior notice, to suspend or terminate Your account and participation in the Program, cancel any pending orders, and revoke any earned or redeemed rewards if MGA reasonably believes that You have: (i) created multiple accounts to obtain duplicative rewards or promotional benefits; (ii) provided false, inaccurate, or misleading information during enrollment; (iii) manipulated, exploited, or abused any aspect of the Program; or (iv) violated these Terms or MGA's Terms of Use. In such cases, MGA may also cancel any orders associated with the abusive activity and issue refunds to the original payment method at MGA's discretion.

Program Abuse

Any attempt to manipulate, exploit, or abuse the Program, including creating multiple accounts, using automated tools to enroll or earn rewards, or engaging in any pattern of activity that MGA determines to be inconsistent with the good-faith use of the Program, may result in disqualification from the Program, account termination, cancellation of orders, revocation of rewards, and forfeiture of accumulated points. MGA reserves the right to pursue any available legal remedies against individuals who engage in fraudulent or abusive conduct in connection with the Program.

MGA may, in its sole discretion, establish limits on the number of rewards that can be redeemed per account, per household, per payment method, or per promotional period. Such limits may be imposed at any time without prior notice.

Limitation of Liability

MGA shall not be liable for any damages of any kind arising out of or in connection with your participation in the Program, including direct, indirect, incidental, consequential, or punitive damages, even if we have been advised of the possibility of such damages. Because some states do not permit the exclusion or limitation of certain damages, in such jurisdictions, liability is limited to the fullest extent permitted by such state law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute between the parties shall be resolved by the appropriate courts located in Los Angeles, California.
